The South Australian Biosecurity Bill 2025 successfully passed through the SA Parliament on 6 February 2025 and will come into force in 2028.
The Dog Fence Act 1946, the Impounding Act 1920, the Livestock Act 1997 and the Plant Health Act 2009 will be repealed and rolled into the SA Biosecurity Bill 2025.
Importantly, the Phylloxera and Grape Industry (PGI) Act remains a standalone Act rather than being rolled into the Biosecurity Bill.
Vinehealth Australia has worked with the SA Government and South Australian grape and wine industry members since 2000 to ensure the PGI Act would not be repealed, and that the powers within the PGI Act would not be diminished with the passing of the Biosecurity Bill 2025.
The PGI Act remain relatively unchanged, except for changes to definitions, as outlined below.
Part 3—Amendment of Phylloxera and Grape Industry Act 1995
- Amendment of section 3—Interpretation
Section 3, definition of Chief Inspector—delete the definition and substitute:
Chief Officer means the Chief Plant Protection Officer under the Biosecurity Act 2025;
- Amendment of section 5—Constitution of Board
Section 5(1)(a)—delete paragraph (a) and substitute:
the Chief Officer; and
- Amendment of section 14—Action to be taken on outbreak of disease
Section 14—delete “Chief Inspector” and substitute:
Chief Officer
- 9—Substitution of section 27
Section 27—delete the section and substitute:
27—Member of Board is an authorised officer
A member of the Board will be taken to have been appointed as an authorised officer under the Biosecurity Act 2025.
